ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE (TOS)

DNS or dynamic name service, is an IP name service allowing you to connect to your computer over the internet and/or services that are installed on your computer without the need for a costly static IP address. Examples of these programs are, web servers, mail servers, pos systems, desktop remote control, video streaming or surveillance software to name a few. If the usage of this DNS service is being used for remote video surveillance, it is to be understood that DNS service is not a monitored video alarm service is only a subscription based DNS-Alaising service that allows use of a DHCP address instead of a costly static to access a computer over the internet. It is also the sole responsibility of the Customer to provide the full internet connection, acceptable upload and download speeds, hardware, cables and/or routers needed for connection to the internet. It is also the sole responsibility of the customer to provide updated and current registration data to BrayGunn.com (BrayGunn & Co) when this information changes or when requested. BrayGunn & Co respects the privacy of its customer, and no personal information will be disclosed to third parties for advertising purposes. Furthermore, Customer grants BrayGunn.com the right to disclose certain Registration Data about Customer and Service information where required to do so by any applicable law or legal process. If any information provided by Customer is determined inaccurate, BrayGunn.com reserves the right to terminate Customer's subscription and rights to use the Service, with or without notification. If you experience downtime or DNS outage it is the customers sole responsibility to initiate calls for service or to troubleshoot issues. Most issues resulting from loss of connection are due to incorrect/reset firewalls, routers, and virus activity, these issues are not the financial responsibility or obligation of BrayGunn & Co. to repair. BrayGunn & Co., will however try to help you troubleshoot and attempt to resolve issues, when a service issue arises on the hosting dns server or computer that it was initially installed. Remote connection issues due to not understanding how to use your home or connecting computer or having incorrect settings on home router/firewall/computer, are service fee based calls and will be charged the base hourly rate to repair or troubleshoot. Also, resolution)s to your connection issues after initial setup and testing has occured, may incur a service/trip fee or hourly charge for the repair. By using this DNS service you are agreeing to and understand that BrayGunn & Co., has no control over the content of your internet usage and is not liable for any damages due to loss of data, service outage, or virus activity occuring on the host or connecting computers. This notice can change without notice, and the current TOS Agreement can always be viewed online at BrayGunn.com.

PAST DUE ACCOUNTS DUE TO NON-PAYMENT. REINSTATEMENT FEE OF $50 CHARGED PER DNS SITE, FOR PROCESSING AND REINSTALLATION OF CONNECTION AFTER DISCONNECTION DATE. IF ON-SITE VISIT IS REQUIRED DUE TO ACCOUNT DISCONNECTION, THE ASSOCIATED TRIP FEES FOR REINSTATMENT ARE BASED ON CURRENT HOURLY RATE CHARGES TO AND FROM SITE ARE BILLED IN ADDITION TO THE RECONNECTION FEE.

The TOS comprises the entire agreement between USER/CUSTOMER and BrayGunn.com (BrayGunn & Co) and supersedes all prior agreements either written or oral, between the parties regarding the subject matter contained herein.  BY REQUESTING AND/OR CONTINUING SERVICE YOU ARE INDICATING YOUR AGREEMENT TO THE TERMS OF SERVICE.
